Acceptable Use Policy

1. Scope
This Acceptable Use Policy (the "AUP") applies to all access to and use of the eterni services, websites, and applications (collectively, the "Services"), offered by myagentworks llc, a New Jersey limited liability company. This AUP is incorporated by reference into, and forms part of, the Terms of Service and any Subscription Agreement governing your use of the Services. Capitalized terms not defined here have the meaning given to them in those agreements.
2. Eligibility
The Services are made available exclusively to licensed funeral homes and death-care professionals acting in that professional capacity. By using the Services you represent that you are such a party, or are duly authorized to act on behalf of one, and that your use is in furtherance of legitimate funeral-home operations.
3. Prohibited Uses
You may not use the Services to engage in, facilitate, or encourage any of the following:
- Any unlawful, fraudulent, or deceptive purpose, or any activity that violates applicable law or regulation.
- Routing non-funeral-related calls, messages, or traffic through the Services.
- Misrepresenting your identity, your organization, or your affiliation with any person or entity.
- Infringing, misappropriating, or violating the intellectual property, privacy, or other rights of any third party.
- Uploading, transmitting, or distributing viruses, malware, or any other harmful or malicious code.
- Attempting to breach or circumvent security; probing, scanning, or testing the vulnerability of the Services; scraping; reverse engineering; or circumventing rate limits or access controls.
- Reselling, sublicensing, leasing, or otherwise making the Services available to any third party except as expressly permitted in writing.
- Using the Services, or any data or output derived from them, to build, train, or improve a competing product or service.
4. Telephony & Messaging Rules
You may not use the Services for unlawful robocalling, autodialing, or messaging in violation of the Telephone Consumer Protection Act (TCPA) or any similar federal, state, or local law. You are solely responsible for providing all legally required call-recording and SMS notices and for obtaining all required consents — including, where applicable, two-party-consent notification in two-party-consent states and valid SMS opt-in from recipients. You may not use the Services to send spam or unsolicited bulk communications.
5. AI Output
The Services use artificial intelligence whose output may contain errors, omissions, or inaccuracies. You must review AI output and remain responsible for the time-critical handling of all communications, including death notifications and on-call escalations. You may not rely on AI output as professional, legal, or medical advice.
6. Data
You may only submit data that you are authorized to share. You may not submit protected health information (PHI) unless an executed Business Associate Agreement is in place between you and us. You may not submit payment card data through the Services other than through the hosted Stripe checkout.
7. Enforcement
Violations of this AUP may result in suspension or immediate termination of your access to the Services. We may remove violating content, restrict access, and report unlawful activity to the appropriate authorities. We may act with or without prior notice where we reasonably determine that immediate action is warranted.
